Sexual Assault
Defendant sentenced to high end of range due to vulnerable adult victim with FASD (CO/Fed; 2009)

Murder 1
Following conviction, defendant sentenced to life in prison rather than death due to FASD functional
impairments (in a previous Murder 1 case prior to FASD diagnosis, same defendant was convicted
of Murder 1 and sentenced to death) (NV; 2009)

Attempted Motor Vehicle Theft, Assault
Juvenile court dismissed both felony charges due to defendant’s MR/FASD-related incompetency
to proceed (WA; 2009)

Murder 1/Robbery
In consideration of defendant’s FASD, prosecutor agrees to bench trial in exchange for dropping
death penalty (PA; 2009)

Attempted Child Enticement (Case 1) / Identity Theft (Case 2)
Jury found defendant with FASD had a “mental defect” but nonetheless convicted him of Internet child
enticement; however, 18 months later in a nearby county, prosecutor offered same defendan plea
bargain based on acceptance of NGI defense due to longstanding FASD diagnosis (WI; 2008, 2009)

Probation Violation
Following multiple probation violations, judge eliminated requirement that defendant with FASD
complete SSOSA outpatient sex offender treatment and permitted him to enroll instead in DDD
